Court reinstates ex-MACRA Director
High Court has reinstated Godfrey Itaye former director general of Malawi Communications Regulatory Authority MACRA and 15 others.
The judicial review follows a complaint that was lodged at Ombudsman on 18th August, 2020 from an anonymous person alleging that there was nepotism, cronyism, tribalism and abuse of office by government in the recruitment of Itaye,
Lead judge Mandala Mambulasa, says there was never any investigation and therefore nothing that MACRA did that could be a subject of judicial review.
He adds that the Court has not agreed with the manner in which Ombudsman assumed jurisdiction to carry out the said investigation.
Mambulasa says the claimants should retain the positions they held and receive all their benefits
Meanwhile, office of ombudsman through its spokesperson Mandy Pondani says is yet to receive the judgment.
