Lawyers of respondents in presidential elections case have cross examined third witness Darlington Ndasauka on Friday
Before the adjournment to Monday next week Ndasauka asked the court to scrap off the statement that fake votes were added to valid votes of president Mutharika.
Attorney general Kalekeni Kaphale and lawyer Frank Mbeta cross examined Ndasauka on Friday morning one after the other.
Kaphale cross examined Ndasauka for 20 minutes before handing over to lead counsel of 1st respondent President Professor Peter Mutharika who is Frank Mbeta.
During Mbeta’s cross examination he took to task the third witness on his knowledge about electoral process as he was the team leader of monitors of UTM party.
In his response Ndasauka said was aware of some processes but Mbeta wondered how a leader cannot know some processes as elections is a critical issue.
Ndasauka stressed that a leader cannot be aware of all things.
Then, lawyer of the witness Marshal Chilenga objected Mbeta’s style of cross examination saying was asking issues which were not in the notice he gave them.
Before the case was adjourned to Monday Ndasauka asked to scrap the statement that fake votes were added to Mutharika’s votes.
On Thursday lawyer of the petitioner Chikosa Silungwe stressed that only lawyer of Mutharika should cross examine the third witness because lawyers of MEC did not give them notice.
The cross examination of Ndasauka begun after lawyers of Mutharika and MEC had cross examined first and second witnesses Saulos Chilima and Mirriam Gwalidi respectively.
