High court in Lilongwe which is the capital city of Malawi has dismissed an application by attorney general Kalekeni Kaphale to end demonstrations which are being organised by Human Rights Defenders Coalition HRDC.
On Friday August 2 2019 Kaphale applied for an interlocutory injunction after announced a 1 million march in three cities of Blantyre, Mzuzu and Lilongwe on Tuesday August 6, 2019.
In his application he said the demonstrations should stop because they have been violent and the elections case is in court.
Kaphale said the demonstrators have been damaging property of innocent Malawians, politicians and businesspersons.
He proposed that HRDC should pay K2bn surety if it wants to hold the demonstrations.
Kaphale surrendered the application to judge justice Mwale who transferred it to judge Kenyatta Nyirenda who set the date of August 5 2019 for hearing the application.
On the day Nyirenda heard from lawyers of HRDC and the attorney general but he reserved the ruling to Tuesday morning.
In the morning of August 6 2019 he dismissed the application hence giving the concerned citizens the power to demonstrate.
The demonstrators have destroyed government buildings such as Karonga district council, armored police vehicle, houses, police post and looting shops among others.
