Elections case has been adjourned prematurely after lengthy discussion on applications which Malawi Congress party MCP has made.
MCP made the applications in preparation for the cross examination of its president Dr Lazarus Chakwera from Tuesday.
However, lawyers of Malawi Electoral Commission MEC and President Professor Peter Mutharika have requested the court to dismiss them which included Chakwera using gadgets.
When the case resumed in the morning the court rejected the appeal by lawyers of Mutharika and MEC that UTM party should pay all costs for withdrawing its witnesses.
They argued that had prepared well for the cross examination of the witnesses therefore the party should pay the costs.
However, the court said “it is not proper to impose costs on the parties because the elections case is being followed by the public hence no need to bar them from accessing the elections justice.”
The court then dismissed the application of the respondents to scrap some evidence of the second petitioner and the long time for cross examinations
Meanwhile, the court has adjourned the case to Wednesday morning.
