Court discharges Plastic Manufacturing Companies Application

High Court has discharged with costs the permission to apply for judicial review that was granted to 11 plastic manufacturing companies on the ban of thin plastics

In his ruling Judge Howard Pemba says the proceedings of the plastic manufacturing companies is an abuse of court process

Pemba says the court is not in the habit of condoning judicial malpractice therefore that has to be put to stop

According to the court on 25th June last year the claimants filed an application before the court seeking various reliefs to judge Mdeza

Among others the application sought an order granting extension of time within which to apply for judicial review

The hearing of arguments from both parties took place on 26th November.

Meanwhile, Environmental activist says thejudgement is commendable but they want a total ban.

Mathews Malata says banning thin plastics alone is not enough hence calling for a revision of the 2015 regulations to remove the ambiguities in the law.

Malata says enforcing the ban would require proper awareness as some do not know that it only applies to the 60 micron thin plastics.

He has asked government to reduce taxes on thin plastic substitutes like raw materials for woven bags so that people can import them and ensure a smooth transition.
