MEC Appeals Against Constitutional Court Ruling On Elections Case
Malawi Electoral Commission MEC has appealed to Supreme Court of Appeal against the ruling of the constitutional court on elections case.
MEC says is not satisfied with the decision the lower court made on Friday 21st June, 2019.
Therefore, the commission has asked the supreme court of appeal to reverse the decision of the lower court
“Among others the lower court complained that there is no requirement under the law for an election petition to be verified by a sworn statement and the irregularities complained against the petitioners were curable,” reads court document
In its appeal MEC says the constitutional court erred in law because the requirement that an election petition should be verified by a sworn statement exists both at common law and under High court rules.
“The court should make an order to strike out or dismiss the two petitions for having been filed without sworn statement, fraudulently and out of time,” adds the document
The commission and president Mutharika are respondents while MCP and UTM presidents Dr Lazarus Chakwera and Dr Saulos Chilima respectively are petitioners in the elections case.
Chakwera and Chilima applied to High court against the results of presidential elections.
