Court finishes hearing elections case
Constitutional court has finished hearing testimony of witnesses in presidential elections case.
President of the judges of the court Hilley Potani closed hearing of the case after lawyers of UTM and MCP cancelled cross examination of last witness of Malawi Electoral Commission Muhabi Chisi as advised by their IT experts.
Potani said the court will give its judgment based on evidence and applicable by law not opinion
He said since the case started on 8th August the court has had 58 sittings excluding 6 December.
“15 witnesses were cross-examined as UTM paraded 4 witnesses after withdrawing 34, MCP 6 instead of 18, Mutharika 2 out of 43 and MEC 3 though it submitted 661 witnesses,” Potani explained
He added that the court will therefore get written submissions from both sides of lawyers from 10th to 18th December.
Potani announced that the court will then convene and hear oral arguments from both parties involved on 19th and 20th December.
