Court dismisses Namalomba’s application against leader of opposition in parliament
High Court in Zomba has dismissed with costs Shadrick Namalomba’s case against leader of opposition in parliament Kondwani Nankhumwa, speaker and Democratic Progressive Party
Lawyers for Namalomba who is Member of Parliament sued the trio on 8th March after Nankhumwa allocated him seat number 100 in the national assembly
Lusungu Gondwe and Gonjetso Dikiya claimed that the defendant acted unlawfully and unreasonably
However attorney general Thabo Chakaka Nyirenda and other lawyers of the defendant argued that Namalomba sued the wrong party as the law does not recognize allocation of seats
In its ruling judge Mzonde Mvula said “Namalomba should have waited for response from the speaker and cannot blame the leader of opposition.”
Therefore Zomba High court discharged the permission to apply for judicial review and interim relief order with costs
